1. Introduction
Welcome to ClaraVu. These Terms of Service ("Terms") govern your access to and use of ClaraVu, including the ClaraVu mobile application, website, features, content, tools, and related services (collectively, the "Service").
ClaraVu is owned and operated by Destine LLC ("ClaraVu", "we", "us", or "our"). By creating an account, accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all users of the Service, including users who access ClaraVu through the mobile application, website, or any related platform.
2. Description of the Service
ClaraVu is a digital skincare support platform that provides non-medical skincare guidance, progress tracking, education, journaling, and related tools. ClaraVu may allow users to complete skincare intake questions, track routines, record product use, capture progress scans or photographs, view scan history, read educational content, and receive cosmetic skincare recommendations or guidance.
ClaraVu's services are intended for general wellness, cosmetic skincare support, and personal progress tracking. ClaraVu does not provide medical care, medical diagnosis, medical treatment, or emergency services. ClaraVu is not a substitute for a licensed physician, dermatologist, esthetician, or other qualified healthcare professional.
Certain ClaraVu features may use software, automation, artificial intelligence, computer vision, or rule-based logic to organize information, support cosmetic skincare recommendations, validate scan quality, or personalize the user experience. These features are provided for informational and cosmetic skincare purposes only and should not be relied on as medical advice.
Users are responsible for deciding whether to follow any skincare guidance, product recommendation, routine suggestion, or educational information provided through ClaraVu. Users should discontinue use of any product or routine that causes irritation or adverse reactions and should consult a qualified professional for medical concerns, severe skin conditions, allergic reaction, infections, pain, or any urgent health issue.
ClaraVu may automatically suggest or apply routine safety adjustments, such as pausing a product, when a user reports moderate or severe irritation or other adverse routine feedback. These adjustments are intended as cosmetic skincare safety support and are not medical advice.
3. Eligibility
You must be at least 18 years old to create an account or use ClaraVu. By registering for or using ClaraVu, you represent and warrant that you are at least 18 years old and that, at the time of registration, you are a resident of the United States or a United States territory.
You may use ClaraVu only if you have the legal capacity and authority to enter into these Terms. If you do not meet these eligibility requirements, you may not create an account or use the Service.
You agree to provide accurate, current, and complete information when creating an account or using ClaraVu, and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
4. User Accounts
To use certain features of ClaraVu, you may need to create an account. You agree to provide accurate, current, and complete information when creating or updating your account.
You are responsible for maintaining the confidentiality of your login credentials, including your password or any sign-in method connected to your account. You agree not to share your account credentials with anyone else.
You are responsible for all activity that occurs under your account, whether or not you authorized the activity. If you believe your account has been accessed without permission, or if your login credentials have been lost or compromised, you should notify ClaraVu as soon as possible.
5. User Content
ClaraVu may allow you to submit, upload, create, or store content through the Service, including facial images, progress scans, journal entries, messages, questionnaire responses, product information, notes, and other information you choose to provide.
You retain ownership of the content you submit to ClaraVu. These Terms do not transfer ownership of your User Content to ClaraVu.
By submitting User Content, you grant ClaraVu a limited, non-exclusive, worldwide license to host, store, process, transmit, display, and use your User Content as needed to operate, maintain, provide, personalize, secure, and improve the Service. This includes using User Content to provide progress tracking, scan history, skincare guidance, journaling, messaging, support, and related ClaraVu features.
You are responsible for the User Content you submit. You agree that you will not submit content that you do not have the right to provide, content that violates another person's privacy or rights, or content that is unlawful, harmful, abusive, misleading, or otherwise inappropriate.
Research use of facial images, scan data, or related submission information is governed separately by any applicable research consent or privacy notice. ClaraVu will not use your User Content for research purposes unless you have provided the required consent.
6. Research Participation
Participation in ClaraVu research is voluntary and governed by a separate Research Consent. You are not required to participate in research to use ClaraVu, and choosing not to participate will not affect your access to the Service.
If you choose to participate in research, ClaraVu may collect, store, analyze, and use the information described in the applicable Research Consent. You may withdraw research permission as described in the Research Consent or related research materials. Research participation, consent, withdrawal, and any research-specific data use are governed by the applicable Research Consent in addition to these Terms and the Privacy Policy.
7. Acceptable Use
You agree to use ClaraVu only for lawful purposes and in accordance with these Terms. You may not misuse, abuse, disrupt, or interfere with the Service or with any other user's ability to use the Service.
You agree that you will not:
- Upload, submit, or share unlawful, harmful, abusive, harassing, defamatory, obscene, misleading, infringing, or otherwise inappropriate content.
- Upload images or information about another person without permission.
- Attempt to access another user's account, data, images, messages, or other information without authorization.
- Attempt to bypass, disable, interfere with, or compromise ClaraVu's security, authentication, access controls, rate limits, or technical protections.
- Introduce malware, harmful code, scraping tools, bots, or automated systems that could harm or burden the Service.
- Reverse engineer, copy, modify, or exploit any part of the Service except as permitted by law.
- Use ClaraVu for medical emergencies, medical diagnosis, or treatment decisions.
- Use the Service in a way that violates applicable law, another person's rights, or these Terms.
ClaraVu may investigate suspected violations and may suspend, restrict, or terminate access to the Service if we believe these Terms have been violated.
8. Cosmetic Purpose and Medical Disclaimer
ClaraVu is intended for cosmetic skincare support, general wellness, education, journaling, and progress tracking. ClaraVu does not provide medical advice, medical diagnosis, medical treatment, emergency care, or professional healthcare services.
ClaraVu is not a medical device and is not intended to diagnose, treat, cure, prevent, or monitor any disease, medical condition, infection, injury, or health concern. Any skincare guidance, product information, routine suggestion, scan-related feedback, or educational content provided through ClaraVu is for informational and cosmetic skincare purposes only.
ClaraVu does not replace advice from a licensed physician, dermatologist, esthetician, pharmacist, or other qualified professional. You are responsible for deciding whether to use any skincare product, routine, or suggestion provided through the Service.
You should seek medical care or professional advice if you have a medical concern, severe or persistent irritation, allergic reaction, infection, pain, swelling, bleeding, sudden skin changes, worsening symptoms, or any condition requiring urgent attention. If you believe you may be experiencing a medical emergency, call emergency services immediately.
9. Purchases, Subscriptions, and Billing
ClaraVu may offer free features, paid features, subscriptions, trials, promotional offers, or other purchases. Pricing, billing terms, renewal terms, and cancellation options will be presented at the time of purchase.
If you purchase a subscription through an app store or third-party provider, your billing, renewal, cancellation, and refund rights may be governed by that provider's terms and policies. You are responsible for managing or cancelling subscriptions through the platform where the purchase was made.
Free trials or promotional offers may be limited to eligible users and may automatically convert to a paid subscription unless canceled before the trial ends, if disclosed at the time of signup.
ClaraVu may add, remove, or modify paid features in the future. We will not charge you for a paid feature unless you authorize the purchase or subscription.
10. Intellectual Property
ClaraVu, including the app, website, software, design, features, text, graphics, logos, icons, images, educational content, workflows, trademarks, service marks, and other materials, is owned by ClaraVu, Destine LLC, or its licensors and is protected by intellectual property laws.
These Terms do not transfer any ownership rights in ClaraVu or its content to you. Subject to your compliance with these Terms, ClaraVu grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial use.
You may not copy, modify, distribute, sell, lease, reverse engineer, scrape, reproduce, or create derivative works from ClaraVu or its content except as permitted by law or with ClaraVu's written permission.
11. Account Suspension, Termination, and Deletion
ClaraVu may suspend, restrict, or terminate your account or access to the Service if we believe you have violated these Terms, misused the Service, submitted fraudulent or unlawful information, interfered with the Service, created risk for ClaraVu or other users, or used the Service in a way that may harm ClaraVu, users, or third parties.
You may stop using ClaraVu at any time. You may request account deletion through the app or by contacting ClaraVu. Deleting your account may remove or disable access to account information, user content, scan history, journal entries, and related data, subject to ClaraVu's Privacy Policy, legal obligations, backup processes, fraud prevention, dispute resolution, and records ClaraVu is required or permitted to retain.
12. Disclaimer of Warranties
ClaraVu is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, ClaraVu, Destine LLC, and their owners, officers, employees, contractors, service providers, and affiliates disclaim all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
ClaraVu does not warrant that the Service will be uninterrupted, secure, error-free, accurate, complete, or available at all times. ClaraVu does not warrant that any skincare guidance, product information, scan-related feedback, educational content, or other information provided through the Service will meet your expectations or produce any particular result.
You understand that you use the Service at your own discretion and risk, and that you are responsible for decisions you make based on information provided through the Service, subject to applicable law.
13. Limitation of Liability
To the fullest extent permitted by law, ClaraVu, Destine LLC, and their owners, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, service interruption, device issues, or unauthorized access arising out of or related to your use of the Service.
To the fullest extent permitted by law, ClaraVu's total liability for any claim arising out of or related to the Service or these Terms will not exceed the amount you paid to ClaraVu for the Service during the three months before the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless ClaraVu, Destine LLC, and their owners, officers, employees, contractors, service providers, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service, your User Content, your violation of these Terms, your violation of applicable law, or your violation of another person's rights.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to jurisdiction of those courts.
16. Changes to the Terms
ClaraVu may update these Terms from time to time. When we make changes, we may update the "Last Updated" date and may provide notice through the Service, by email, or by other reasonable means.
Your continued use of ClaraVu after updated Terms becomes effective means you accept the updated Terms. If you do not agree to the updated Terms, you should stop using the Service.
